Kivo Pilot offers AI-powered chatbot solutions to businesses for automating customer interactions, improving AI models, and streamlining appointment scheduling.
3. Eligibility
Kivo Pilot’s services are only available to businesses.
By using the service, you confirm that you are authorized to act on behalf of your business and that you meet the eligibility requirements.
4. Payment Terms
Kivo Pilot offers subscriptions and one-time fees for services.
Payments are billed on a monthly basis.
No refunds are provided for any payments.
User Cancellation: You may cancel your subscription at any time.
Company Cancellation: Kivo Pilot may cancel your subscription at any time.
Payment Obligation: You are responsible for paying the subscription fee until the end of the current billing cycle after cancellation, excluding any contracts with specific term periods.
5. User Responsibilities
You agree to use Kivo Pilot’s services for lawful purposes only.
You may not misuse the AI for generating harmful, abusive, or unlawful content.
You are prohibited from infringing upon third-party intellectual property rights while using the service.
6. Company Rights
Kivo Pilot reserves the right to suspend or terminate your account if you violate these Terms of Service.
Kivo Pilot also reserves the right to modify, change, or discontinue services at any time without prior notice.
7. Intellectual Property
Kivo Pilot’s IP: All software, AI models, and branding are the intellectual property of Kivo Pilot.
Client Content: You retain ownership of all data and content you upload or input into the service.
AI Outputs: You own any outputs generated by the AI, subject to your permitted use of the service.
8. Liability Disclaimers and Limitations
Kivo Pilot does not warrant the accuracy, reliability, or quality of AI-generated content.
Kivo Pilot is not liable for any errors or inaccuracies in AI outputs.
Limitation of Liability: Kivo Pilot’s liability is limited to the amount you paid for the service in the last 12 months.
No Liability for indirect, incidental, or consequential damages, including data loss, business interruption, or third-party claims.
9. Governing Law and Dispute Resolution
Governing Law: These terms are governed by the laws of the state of Illinois, United States.
Dispute Resolution: Any disputes will be resolved via binding arbitration in Illinois, under the rules of the American Arbitration Association (AAA).
10. Termination Conditions
User Cancellation: You may cancel your subscription at any time.
Company Cancellation: Kivo Pilot can also cancel your subscription at any time.
Payment Obligations: You must pay for the service until the end of the current billing cycle after cancellation, except in the case of signed contracts that specify a minimum commitment period.
11. Force Majeure
Neither party will be held liable for any failure or delay in performance under these terms caused by events beyond their control, including natural disasters, war, pandemics, or other unforeseen circumstances.
12. Severability
If any provision of these Terms of Service is deemed invalid or unenforceable, the remaining provisions will remain in full effect.
13. Amendments
Kivo Pilot may modify these Terms of Service at any time by posting updated terms on the website. Your continued use of the service after any changes constitutes your acceptance of the new terms.
14. Entire Agreement
These Terms of Service, together with any policies or guidelines incorporated by reference, constitute the entire agreement between you and Kivo Pilot regarding your use of the service.
